Terms & Conditions

1. Acceptance of Terms and Conditions

1.1 Mytaxexperts.co.uk, an e-service website, is operated by My Tax Experts Limited, a service provider with the company number 14626751 and VAT number 477874719.
 
1.2 By making a claim with us, or by using any of our services, you are agreeing to the following Terms & Conditions.
 
1.3 If there are any parts of this agreement that you are unclear about, please get in touch with us before proceeding. All of these Terms and Conditions apply to the supply of services unless we specify otherwise.


1.4 No variation, exclusion, or addition to any term of the contract shall be binding on MTE unless expressly agreed to in writing by MTE. No variation, exclusion or addition of any term of the contract shall be binding on MTE unless agreed in writing by MTE.


1.5 These terms are in, an governed, by the English language.

 


2. DEFINITIONS AND INTERPRETATION
2.1 The definitions and rules of interpretation outlined in this clause apply to these conditions.


"We," "Us," and "Our" refers to My Tax Experts Limited, Company number: 14626751.
“MTE” means My Tax Experts Limited.
"You" and "Your" refers to you or your nominated representative using our service on your behalf.
"Claim" refers to your instruction for us to recover overpaid tax from HMRC.
"Claim Form" refers to the signed instruction you provide, enabling us to act on your behalf.
"Website" refers to our company's website,https://mytaxexperts.co.uk/.
“Privacy Policy” means the terms which set out how we will deal with confidential and personal information received from you via the Website;
“Services” refers to any and all of the services performed by us pursuant to a contract.
“In Writing” includes emails

 


3. CHARGES AND PAYMENTS
3.1 Under normal circumstances we take our fee directly from your refund when received from HMRC; if you have a liability owed to HMRC that was not declared / not known at the time of procuring our services, we reserve the right to seek payment of the full charge directly from you for services provided.


3.2 Our standard fee is 30% + VAT of any refund we obtain for you.


3.3 A minimum fee of £50 + VAT (£60 in total) will apply to any successful claim. Where the refund from HMRC does not cover this, we will not ask you to pay any additional charges and the claim will be closed. We reserve the right not to contact you in this instance.
 
3.4 If a tax refund was already in the process before you initiated a claim with us, and we receive it as a result of your claim, our fees as outlined in 3.2 and 3.3 will apply to the entire refund.
 
3.5 If you can provide satisfactory evidence that a refund was already in process before your claim, we may consider a partial refund of our fee but are under no obligation to do so.


3.6 We reserve the right to charge a further administrative fees for additional administration caused by further Tax Affairs that are not related to the Claim submitted by My Tax Experts on your behalf. If this happens, you will be provided with an itemised invoice and the charges will not be in excess of £150.


3.7 Following the clearance of funds from HMRC, the net tax refund amount, after the deduction of our fees, will be remitted via BACS.


3.8 Any amounts unclaimed after a period of 180 days will be subject to a charge equivalent to 100% of the claim value.

 

 

4. CLIENT’S OBLIGATIONS
 
4.1 You agree to authorize and register us as your nominated tax agent with HMRC. All correspondence related to your application must be managed directly by us. Any direct contact with HMRC without prior consultation with us will be considered a breach of these terms.
 
4.2 Entirely, it is your responsibility to validate the completeness, truthfulness and accuracy of the information you provide to MTE.
 
4.3 MTE assumes no responsibility for the veracity of the information provided, fraud by false representation is a criminal offence under the fraud act 2006.
 
4.4 You agree to cooperate with us to the fullest extent so that we can provide the services in accordance with our obligations.

 

4.5 You agree to provide us with any and all relevant information needed within a prompt timeline, this includes taking any necessary steps to get the required information from other sources.

 

4.6 You agree to keep accurate records and receipts as required by HMRC to support your Tax Refund claim and retain them for seven years following the tax year to which your claim relates.


4.7 To facilitate the processing of your claim, you must disclose all sources of earnings and the corresponding amounts received, irrespective of their source of origin. This includes, but is not limited to, income from PAYE employment, self-employment, and income derived from assets, for each tax year in which we are preparing a tax return or claim on your behalf.


4.8 For the purpose of your claim, you are required to disclose all expenses related to your business and work activities. You must and provide supporting documentary evidence to support your expenditures should we request it.


4.9 You acknowledge that any funds received based on incorrect information provided by you may need to be repaid. In such instances, you agree that My Tax Experts, including our fees, will not be liable for reimbursement.


4.10 You agree to authorise and register us as your nominated tax agent with HMRC to receive your refund directly from HMRC from which our fee will be deducted.

 


5. FACILITATING CLAIM
5.1 Where further information or clarification is required in relation to any aspect of your claim, we will always try to contact you however we reserve the right to not contact you, and instead:

5.1.1 Cancel your claim.
5.1.2 Put your claim on hold, indefinitely.
5.1.3 Remove any parts of your claim that are in question, before submission to HMRC.

 

5.2 We reserve the right to submit your claim to HMRC as it is and will not be held liable for any errors that result in HMRC issuing an incorrect refund of tax, or your claim being refused altogether.


5.3 MTE assumes no liability for claims rejected by HMRC due to inaccurate; erroneous or misleading information provided by you. MTE reserves the right to end our contract with you and claim any compensation that is due if this is applicable.


5.4  HMRC may occasionally require additional information from you to process your claim. While we will assist wherever possible, the responsibility to provide the requested information ultimately rests with you. MTE will not be held liable for any delays in your claim resulting from your failure to fulfill this obligation.


5.5 My Tax Experts Limited has an agreement with Definitive Accountancy Limited, an accountancy firm and partner of MTE. Where appropriate, MTE, in coordination with Definitive Accountancy Limited, will oversee the progression of your application.

 


6. DISCLAIMER OF LIABILITY
6.1 If HMRC requests or recalls any amount from your tax refund claim, for any reason, we will not be obligated to refund our fee for services provided.

 


7. CLIENT’S REFUND
7.1 The information you provide will be used to calculate your estimated rebate amount. This estimate should not be construed as a guarantee of the amount of refund we may be able to recover on your behalf.


7.2 MTE shall not be held liable for any instances where the actual refund is lower than the estimated amount, or if your claim is denied.


7.3 MTE strongly advises against making any financial commitments based on an estimate or the expectation of a tax refund. We shall not be held liable for any loss, hardship, or financial consequences, whether direct or indirect, arising from such actions.

 


8. TERMINATION OF SERVICE
8.1 We reserve the right to decline or cancel your claim at any stage, without any obligation to provide an explanation.


8.2 You may cancel your claim within 14 days of registration without incurring any fees. To initiate cancellation, please notify us promptly so the necessary actions can be taken.


8.3 Once your claim has been submitted to HMRC, cancellation is no longer permitted. If exceptional circumstances apply, you must notify us immediately. While we will review your request, we are not obligated to approve it.


8.4 Claims cannot be cancelled under any circumstances once they have been approved by HMRC and a refund has been confirmed.

 

 

9. DATA PROTECTION AND ANTI-MONEY LAUNDERING
9.1 For details on how we process your data, please refer to our Privacy Policy on our website, https://mytaxexperts.co.uk/privacy-policy/.
 
9.2 We are registered with HMRC for  anti-money laundering supervision (as required under  AML regulations). Our registration number is XHML00000202056.
 
9.3 In compliance with Anti-Money Laundering (AML) regulations, we are required to conduct customer due diligence. This process involves obtaining identity documents from you to verify your identity. Typically, we will request government-issued documents, utility bills, bank statements, and other official records to validate your identity.

 

10. LIMITATION OF LIABILITY
10.1 Unless agreed upon in writing the total liability for any and all damages incurred will be upto the amount of the total fees payable by you under the contract.


10.2 We will not be responsible or liable for any loss, damage or expense incurred or sustained if information material to the service we are providing is withheld or concealed from us or misrepresented to us. This applies equally to fraudulent acts, misrepresentation or wilful default on the part of any party to the transaction and their directors, officers, employees, agents or advisers. This exclusion shall not apply where such misrepresentation, withholding or concealment is or should (in carrying out the procedures which we have agreed to perform with reasonable care and skill) have been evident to us without further enquiry, beyond that which it would have been reasonable for us to have carried out in the circumstances.

 

11. LAW AND JURISDICTION

11.1 MTE T&C’S are governed by and constructed in accordance with English Law. Any disputes arising under these Terms and Conditions shall fall under the exclusive jurisdiction of the English courts.

12 CHANGES TO OUR T&C’S 

12.1 Changes in the law and/or within the way we operate may merit alteration of our standard terms and conditions. Notification of any such changes will be provided.
 
12.2 Any changes to our fee structure the above remains applicable to any future changes to our fees.
